1. Agreement to Terms
By accessing or using ModelLink 3D ("the Service"), operated by Altonuva LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.
2. Description of Service
ModelLink 3D is a platform for uploading, hosting, and sharing 3D models with augmented reality (AR) viewing capabilities. The Service includes:
- 3D model hosting and storage
- Shareable viewer links and embed codes
- AR viewing on compatible devices
- Personal and public gallery pages
- SketchUp plugin for direct export
- QR code generation
3. Account Registration
To use the Service, you must:
- Be at least 13 years old (or the minimum age in your jurisdiction)
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
You are responsible for all activity that occurs under your account.
4. Subscription and Payment

Billing
- Paid subscriptions are billed monthly via Stripe
- Subscriptions automatically renew unless cancelled
- You may cancel at any time; access continues until the end of the billing period
- Refunds are provided at our discretion on a case-by-case basis
Price Changes
We may change subscription prices with 30 days' notice. Continued use after the change constitutes acceptance of new pricing.
5. Your Content
Ownership
You retain full ownership of your 3D models and content. Uploading content to ModelLink 3D does not transfer any ownership rights to us.
License to Us
By uploading content, you grant us a limited license to:
- Store your content on our servers
- Display your content through our viewers (web, AR, embed)
- Generate thumbnails and previews
- Process your content as necessary to provide the Service
This license is solely for operating the Service and terminates when you delete your content or account.
Your Responsibilities
You represent and warrant that:
- You own or have the necessary rights to the content you upload
- Your content does not infringe any third-party intellectual property rights
- Your content does not violate any applicable laws
- You have obtained necessary permissions for any third-party materials included in your models
6. Prohibited Content and Conduct
You may not upload content or use the Service to:
- Infringe copyrights, trademarks, or other intellectual property rights
- Distribute malware, viruses, or harmful code
- Share illegal, obscene, or pornographic material
- Harass, threaten, or harm others
- Impersonate any person or entity
- Engage in fraudulent activity
- Attempt to gain unauthorized access to the Service or other accounts
- Interfere with the Service's operation or security
- Scrape, crawl, or bulk download content from the Service
- Resell or redistribute the Service without authorization
Violation of these terms may result in immediate account termination without refund.
7. Intellectual Property
Our Property
The Service, including its design, features, code, and branding, is owned by Altonuva LLC and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.
Feedback
If you provide suggestions or feedback about the Service, we may use it without obligation to you.
8. Third-Party Services
The Service integrates with third-party services (Stripe for payments, etc.). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.
9. Model Retention and Deletion
Active Subscriptions
Models are retained according to your subscription tier limits.
Expired or Cancelled Subscriptions
- Models are marked as "Expired" immediately
- Expired models display an overlay but are not deleted immediately
- Permanent deletion occurs 30 days after expiration
- We send a warning email 7 days before permanent deletion
- Reactivating your subscription restores access to expired models (if within 30-day window)
Account Deletion
You may request account deletion at any time. Upon deletion:
- All your models and data will be permanently removed
- Share links and embeds will stop working
- This action cannot be undone
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted or error-free
- The Service will meet your specific requirements
- The Service will be compatible with all devices or browsers
- Your content will be preserved indefinitely
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALTONUVA LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.
Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Altonuva LLC, its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from:
- Your use of the Service
- Your content
- Your violation of these Terms
- Your violation of any third-party rights
13. Modifications to Service
We reserve the right to modify, suspend, or discontinue the Service (or any part) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting a notice on the website or sending an email. Your continued use of the Service after changes constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Utah.
16. Dispute Resolution
Before filing a legal claim, you agree to attempt to resolve disputes informally by contacting us at support@modellink3d.com. We will try to resolve the dispute within 30 days.
17. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
18. Entire Agreement
These Terms, together with our Privacy Policy and any subscription-specific terms, constitute the entire agreement between you and Altonuva LLC regarding the Service.
